Hiring a Criminal Lawyer

There are a number of situations in life when you have to decide whether to hire a lawyer. For instance, if you're purchasing a house or having trouble paying your bills, hiring a lawyer may not be a necessity, but it's a good idea nonetheless. However, if you've been charged with driving under the influence, assault, or some other crime, hiring a criminal lawyer is mandatory. You'll want to make sure that your legal rights are protected throughout the entire judicial process.

But where do you begin, when you're hoping to hire a qualified criminal lawyer? One of the best ways to find an effective attorney is to consult with your family and friends. There is nothing better than a personal recommendation, especially one that comes from someone who is close to you. However, there are times when it might be difficult to obtain a personal referral. In those situations, you might consider consulting the local bar association or an Internet site such as lawyers.com. The Internet, in fact, can provide a wealth of information about individual lawyers. For instance, you can find out about a lawyer's level of expertise in criminal law, biographical information, whether the lawyer is in good standing with the bar, and other pertinent facts. In addition, online archives of your local newspaper might include articles about cases that a particular lawyer has tried. You'll want to hire a lawyer with plenty of experience in the area of criminal law involved in your case, whether it be traffic offenses, drug crimes, or white collar crimes.

The next step is contacting the lawyer's office. If an attorney cannot meet with you on short notice, don't count the lawyer out. Effective lawyers are quite busy, so, if a lawyer is short on time, that may actually be a positive sign. Pay close attention to how your call is handled by the lawyer's staff. The staff should be courteous and be willing to answer all of your questions.

You should be aware of the fact that criminal defense lawyers tend to charge by the hour. As an alternative, they may charge a flat fee up front. Generally speaking, rules of professional conduct bar a lawyer from charging a contingency fee for a criminal case. Since legal fees can vary, you might want to engage in some comparison shopping. However, be advised that the better lawyers tend to charge more for their services. Since your freedom and reputation are at stake, you should invest in the best lawyer you can afford.

Given the fact that criminal cases are often settled through plea agreements with a district attorney's office, it can be important for a criminal lawyer to be on good terms with the D.A. Certainly, good relations between the two can only enhance your case. Therefore, you'll want a lawyer who has fairly regular contact with the prosecuting attorney in the county in which your case resides. Also, it's a good idea if you hire a lawyer who is affiliated with a group such as the National Association of Criminal Defense Lawyers. Such an association shows that your lawyer wants to keep abreast of new developments in the area of criminal law.

Prior to hiring a criminal lawyer, be sure to ask for references. You'll want to know how clients view the attorney's expertise. You should also obtain a copy of the law firm's brochure, so you have a clear understanding of the outfit you're dealing with. It is also vitally important that you obtain a copy of the lawyer's retainer agreement so that you're aware of any up-front costs involved in obtaining legal representation.

In the end, you'll want to select a lawyer that you're comfortable with, one that truly understands your case and can work well on your behalf. You'll find that an effective criminal attorney is well worth his or her fee.

Thinking Of Hiring A Criminal Defense Attorney?

If you have been arrested or accused of a crime that has the potential of jail or prison time, you may want to seriously consider hiring an attorney to represent you. Unless you don’t mind the possibility of spending time in jail, you’ll probably want the services of an attorney.

Almost any expert will strongly advise a person against representing him or herself in court unless they are very knowledgeable about the field of law; and even then he or she will still be discouraged from representing him or herself for a criminal case. Less than one percent of people represent themselves in a criminal case. The vast majority of people engage the services of an attorney. That is because it is very difficult for someone to represent him or herself in court.

You wouldn’t want someone without any knowledge of how to do heart surgery doing a heart transplant on you would you? Likewise, would you want to represent yourself in court and face possible prison time without having the best possible legal advice available to you?

If a person cannot afford to hire an attorney the court will appoint an attorney, typically called a public defender. The constitution of the United States requires a person be provided with legal representation if they cannot afford it. But it is only required if a person is facing possible jail or prison time. If a person is only facing the possibility of a fine, the court is not required to provide the defendant with an attorney.

A court appointed attorney may not cost the defendant any money or the defendant may receive the court appointed attorney at reduced fees. It depends on the income of the defendant. If a person wants a public defender they will be required to fill out financial documents for the court to determine whether or not they qualify for a public defender and also whether or not that they receive the services of the public defender for free or at a reduced cost.

If a person qualifies for a reduced cost court appointed attorney, it is generally called a partial indigency. At the conclusion of their case, the judge will require the defendant to reimburse the county or state for a specific portion of their legal fees. The rates are usually much lower than those charged by private defense attorneys.

If you do not qualify for a court appointed attorney and are hiring one on your own, how do you find one? Personal recommendations from people you know are almost always the best way to find an attorney. Other sources of information to help find a criminal attorney are: Internet, Yellow Pages, your civil practice attorney, your local bar association lawyer referral panel (if they have one) and the Martindale-Hubbell publications.

The Martindale-Hubbell publications are available at most libraries and on the Internet. The publications do their best to list every attorney in the US by geographical area and lists the area or areas of law that attorney specializes in.

When hiring a criminal attorney on your own, try to interview several attorneys before hiring one or ask your family and friends help you. It is important to find an attorney you feel comfortable discussing all aspects of your case with. Some defense attorneys offer a no cost personal interview consultation. One thing to remember when hiring an attorney: make sure you hire an attorney who specializes in your area of criminal law.

Most attorneys will require an up-front retainer fee which can be a significant amount depending on the type of criminal case you have.

Some attorneys charge a set fee for handling a specific type of case. But it is more common for an attorney to charge by the hour. Some attorneys who charge by the hour will set a cap fee for the case. That means a sum will be agreed on that is the highest amount the defendant has to pay. If the hourly costs reach this set amount, the lawyer will finish representing the defendant through to the completion of the case without charging any more money.

Although contingency fees, which are where an attorney only gets paid if he or she wins the case, are common with certain types of civil cases, they are not used with criminal cases. Contingency fees are considered unethical and are not permitted in criminal cases.

In addition to knowing what fees an attorney will be charging, a defendant also needs to know what services those fees cover and do not cover. Fees such as the cost of expert witnesses are normally not included in the normal fees of an attorney.

Deed Theft Criminals Get More Aggressive at Stealing Your Home

Deed theft is an increasingly popular crime in the real estate industry. It usually works like this: A company will post signs around town offering to "help" those facing debt problems that might lead to foreclosure. Representatives of the company meet with the homeowner and offer to take over the payments for a year or so while the owner gets his or her finances in order. The company urges the owner to sign over the property to the company, with the understanding that after a year or so, the owner may buy the property back. It seldom, if ever, works that way. Once the property is signed over, the company often evicts the former owner and sells the property at a profit. The owner gets nothing.
This scam has been working well for years, but apparently isn't efficient enough for some crooks. In a new twist, some clever criminals have found a better way. Now, instead of pretending to help, the crooks just forge the owner's name on a quitclaim deed and file it with the county. A quitclaim deed is a statement from a property owner that he or she no longer wishes to maintain any interest in the property. That document specifies who will take over ownership.
In some places, the thief will have the document notarized by an accomplice. In others, the thief will simply take advantage of an overworked or inattentive notary public before filing the document with county clerks who usually don't bother to check if the document is legitimate. In either case, the result is the same. The thief now "owns" the property and is free to sell it or refinance it. Usually, once having done so, the thief and the money disappear. Under the right circumstances, this can even happen without the real owner even realizing that it has happened.
This type of theft is becoming more and more prevalent in hotbeds of mortgage fraud such as the Southeastern United States. Law enforcement agencies are often at a loss as to how to follow up on this crime, as they often will have little more to go on than a name on a document, which may not even be real. In the meantime, clerks and notaries public are being urged to scrutinize such documents more carefully. Deed theft and mortgage fraud are serious problems that are costing Americans hundreds of billions of dollars annually.

Criminal Background Checks

Everyday the news tells of violence in the workplace and sex offenders on the prowl. The scary thing is that you usually never know who these people might be until it's too late. How many times have you seen an interview of someone describing an accused criminal as the nicest person you could ever know? They would have never suspected this person of committing any crime until the crime had already been commited. A criminal background check could have easily put up a red flag about this person and it might have prevented a future incident.
With the popularity of internet dating, the threat of sex offenders seems to increase daily. It is estimated that the number of Americans using online dating services like myspace.com and match.com is in the tens of millions. Sex offenders now have easy access to millions of potential victims. So how do you protect yourself? You should obtain a criminal background check on anyone you meet online before ever agreeing to meet with them and never agree to be alone with them until you feel safe. When your safety is in question, don't take a chance: get a criminal background check.
Violence in the workplace also seems to be on the rise. According to USA Today, an average of one employee is killed in the workplace every week in the United States. Furthermore, at least 20 workers are seriously injured in violent attacks by a current or former employee. How could these brutal attacks have been prevented? In most cases, a criminal background check could have revealed a history of violence and may have prevented many incidents from occuring. It is now more important than ever to know if someone has a criminal background or history of violence before you hire them.
The process of obtaining a criminal background check on someone used to be a hassle. It took someone with specialized knowledge and a whole lot of effort to gain access to public records of all sorts including criminal records and civil records. Now, because of the speed and convenience of the internet, obtaining a criminal background check on virtually anyone in the United States (and even Canada and the U.K.) could not be any easier. Whether someone has an unpaid parking ticket, or has been convicted of a felony, these public records are all available to anyone.
A criminal background check can and should be used in any situation where safety is an issue. It is extremely difficult for anyone to know you are investigating them so you can conduct one in complete anonymity. Don't become a victim of violence when you can protect yourself in such an easy and valuable way: do a criminal background check.

California, What happens when you get a DUI?

This is one of the most common questions asked to DUI lawyers. When you ask lawyers this question, you do not always get straight answers because every circumstance is different. According to DUI.com the most common penalties are as followed.

$1200 fine

3 years probation

3-5 days sheriff work alternative program

4 months suspended license

First offender school

When a driver in the state of California is arrested for driving under the influence of alcohol their driver’s license is immediately confiscated by the police and then served with the DMV’s ‘Notice of Suspension’. This will formally suspend their license, provide temporary driving privileges for 30 days and will also explain some aspects of the applicable law. In addition, it states that there is a right to contest the suspension and force the DMV to return the license as long as the DMV’s Local Driver Safety is contacted by the attorney within 10 calendar days of the arrest.

A driver’s license is immediately suspended if their blood alcohol level is above .08% (or above .01% for drivers under 21 years of age) or if they refuse to take a chemical test. If the driver is from another state other than California, then the officer has no right to seize their license. However, the officer will issue a ‘Notice of Suspension’ which suspends the driver’s license in the state of California (after 30 days) from driving. If there is a conviction in court, the state of California will contact the home state of the convicted party, and that state will usually suspend their license the same way they do it there.

Ramification of Getting a California DUI

First off – getting a DUI will cost you money.

First offence: $390 - $1000 plus local fees, penalties and assessments for total of $1300 - $3500. This doesn’t include any lawyers fees –which can be from $500.00 to $15,000 depending on if you’re in a small town or large metro area. Generally speaking the more experienced the lawyer (and you want an experienced lawyer) the more it will cost.

There are social ramifications of getting a DUI as well. A charge of DUI/DWI can have serious ramifications on a defendant's driver's license, criminal record and ability to work and function in society. Some employers may decline in hiring someone because of a felony level DUI.

Ask yourself before getting behind the wheel after drinking if it’s really worth it. Based on the above –a cab ride home is downright cheap. Be safe –not sorry.

The Arrest Process in New York

When you are arrested, your first contact will be with the local police precinct. The person who arrests you is the “arresting officer.”
The arrest process can legally take up to three days (72 hours) before you see a judge for arraignment. Throughout this process, you must remain silent about everything, except you can give basic information such as your name, residence, and other identifying information. But do not speak about anything else to anyone, even the person who might be in the cell with you. Always remain silent until your attorney speaks with you because anything you say to nayone at this point can and will be used against you.
At the precinct, a detective will interview you to get basic information (like your full name, present address and family member contact information) and possibly try to get information from you to use as evidence against you. Do not say anything except give your basic identification. The detective may ask you for contact information of your family or friends who can verify who you are and where you live. If you provide your home number or other numbers then the arresting officer may call your family or friends to verify your information. He may even ask further information about you that may incriminate you later. You should be careful what numbers you give out and at least call the person who you may refer to the police first and let them know just to verify who you are and nothing else.
While you are at the precinct, the police will definitely run a check on you to discover if you committed other crimes or if outstanding warrants exist for your arrest. This information is also needed for the arresting officer to fill out the paperwork to get you through the arrest process and to the arraignment court.
The police will fingerprint you and take arrest photos. Then the arresting officer will make a file for you from the information he obtains from you, prints, photos and his notes. He will then fax the file to the District Attorney’s office so they can draft a criminal complaint against you and assign your case file a docket number.
You’ll sit in the precinct jail cell an average of six hours until they can arrange transportation for you to another place called “Central Booking.” Whenever they transport you they will handcuff you, so be prepared to cooperate and go through the motions.
At Central Booking
The Central Booking process can take about four hours. You’ll wait in line with hundreds of other arrested persons to get to an interview table. At the interview table an intake person will ask you about any health problems you may have and more identifying information, including:
- Persons to contact
- With whom you live
- Where you work
- Your salary
- Your citizenship status
- Where you were born
This information will later be used by your arraignment judge to determine if bail is required and the amount of bail you will pay. If you do not have any contacts in the state or locally or you travel alot or are not a citizen of this country then you most likely will have to pay bail because you will be considered a “flight risk”.
The best thing you can do is get an attorney to meet you at your arraignment. You can do this at Central Booking, where there are pay phones. Call an attorney, or call your family, friends or anyone else who can get you an attorney that day. That call will be short because there are hundreds of other people waiting to use the phone. Just tell whomever you call:
- The precinct you came from
- Where you are now
- The charges against you or what you believe you were arrested for
- To get as much cash as possible
- To bring proof of home ownershi, like a deed
- To contact at least three bail bondsmen from the phone book in the area you were arrested in (in order to arrange for bail quickly)
With your arrest location, precinct information and last name, a good attorney will be able to track you down using special contact numbers to the District Attorney’s office and Central Booking (where your arrest number and docket number can be obtained).
At some point you and a group of about 10 others from your cell will be brought upstairs. This means the District Attorney finished the paperwork and assigned a “docket number” to your file so you can be arraigned. If your attorney has been tracking you through the system then he or she will know when to start traveling to the arraignment court to appear for you so you do not have to wait longer.

This article is certainly not all inclusive and is intended only as a brief explanation of the legal issue presented. Not all cases are alike and it is strongly recommended that you consult an attorney if you have any questions with respect to any legal matters.

The Workman's Compensatory System

Workman's Comp is a benefit system that was established decades ago to safeguard workers in the event they became hurt on the job. Fundamentally, the system works like this: when a worker becomes injured, rather than sue their employer (which around the turn of the century was the only option available to an injured worker), an employee can file a claim that provides for the following:

1. Protection of the worker's job (an employer cannot fire an employee simply because they are injured)

2. Continuation of the worker's pay while the worker is injured.

3. Payment of medical expenses (usually including the cost of emergency care, necessary surgery, and rehabilitative services).

Workman's comp essentially relies on the concept of employer liability for job injuries and work related illness but with no fault. In other words, the way the workman's comp system is setup (regardless of the state in which a worker lives), the benefits flow in two ways.

On the one hand, an employer will provide an injured or sick worker certain benefits that are normally covered under workers comp (which normally includes medical care, payment of a certain percentage of a worker's wages, and, in many cases, the continuation of certain benefits); on the other hand, the employer will not normally face litigation for work related injuries or illness.

In many unfortunate situations where a workplace accident or injury has occurred, workman's comp can ideally provide an injured worker with necessary medical care and replacement income during the time for which the worker is unable to work. However, not all situations are ideal. In such instances, a worker may have difficulty with an employer or the employer's insurance carrier (for all intents and purposes, the two entities are, in a workman's comp claim, one and the same). And the rational for this is, sadly enough, fairly clear. Each time an employer's insurance carrier is forced to "payout" on a claim, the cost of the employer's insurance premium rises. In other words, the interests of the employer and the injured worker are sometimes, if
not often, at odds.

What should you do when you've been injured on the job and learned that your workman's comp insurance is reluctant to pay? Get a consultation with an attorney who specializes in this type of labor law. Because when an insurance company's financial interests are in opposition to your own, it makes perfect sense to be fully armed, in a legal sense.

Filing A Mesothelioma Lawsuit

Mesothelioma is a deadly cancer that is caused by exposure to asbestos fibers, and this cancer can reduce lifespan to a matter of months from the onset of symptoms. Over recent years, the number of mesothelioma cases coming to light has risen quite dramatically, and in line with this, the number of mesothelioma lawsuits being filed has also increased. Because mesothelioma lawsuits have become such big business, many law firms and lawyers now specialize in this area, making it easier for those affected by this disease to get the legal assistance they need to file a mesothelioma lawsuit.

The first thing to remember about filing a mesothelioma lawsuit is that you have to act quickly. Each state operates within a statute of limitation, which means that those affected by this disease have a certain time within which to act. These statutes of limitation apply to both affected parties and to relations that may be filing a mesothelioma lawsuit in the event that the affected party has already passed away. The faster you act with regards to getting legal assistance the better. Filing your mesothelioma lawsuit as early as possible could make the difference between a successful and unsuccessful compensation claim.

Many people worry about the cost of filing a mesothelioma lawsuit, but the majority of mesothelioma lawyers and law firms now operate on a contingency fee basis. This means that clients do not have to pay any money up front, and the lawyer takes his fee from any compensation awarded as a result of the mesothelioma lawsuit. If no compensation is awarded, then you do not have to pay any fees for the legal action that has been taken.

An experienced mesothelioma lawyer will be able to offer advice on the likely success of your mesothelioma lawsuit based upon your own individual circumstances. Although it is impossible to predict how much will be awarded as part of the mesothelioma lawsuit, an experienced lawyer will be able to draw on experience from past cases to give you an idea of how much you might get. The compensation received as a result of filing a mesothelioma lawsuit is designed to cover a range of costs. Compensation often runs into six figures for claimants, and this is to cover medical expenses, pain and suffering, and also to secure a financially stable future for their families. Although the exact compensation awarded can vary from one lawsuit to another, a mesothelioma lawyer will aim to get as much compensation as possible for an affected client.

Taking early action when filing a mesothelioma lawsuit could really benefit you, and will enable your mesothelioma lawyer to collate all the necessary facts and information in order to put together a watertight case. This can make a big difference to the success of your mesothelioma lawsuit, and acting quickly will help to ensure that your case is actioned within the time limitations set by the state. Although thinking about legal action can be difficult when you have been diagnosed with a cancer such as mesothelioma, it is important to seek legal assistance as soon as possible following diagnosis. This is to ensure that you and your loved ones stand as high a chance as possible of getting the compensation to which you are entitled.

"America’s Voiceless” The Children of Divorce

When people start a new relationship, it is as though Cinderella and her Prince stepped out of that childhood story. A more realistic way to look at it is to think of it as two people who are running for office, campaigning to be in the other person’s life. Forget that it is not who they will be later in life. We are too busy getting the other person to “choose us” so we can live happily ever after. There is, bad habits early on in the relationship we never see. For instance, leaving dirty clothes scattered, drinking directly out of the juice carton, putting a dirty knife back in the drawer and watching from around the corner as they lick it clean, washing is too much effort. Both sides hide their bad habits when they begin dating, because they are too busy running for the highest office in the country, ultimately the office of marriage and parenthood.

This fantasy life fades as people grow together in a relationship. Unfortunately, about sixty percent grow apart during the marriage.

When the marriage ends it is like a house set on fire. All desired hopes, dreams and commitment cherished by both sides, up in smoke. But, we forget that the child of this relationship has yet to lay the foundation of their lives.

Divorce on any level, is devastating. For children, their warm, safe world is suddenly shattered like a broken toy, in many pieces. When parents begin to divorce, do they really stop and think about the children? All too often, the children fall under the invisible heading of “power base” or worse yet, “negotiable”.

A child’s life during a divorce is like a roller coaster, going up minute and down the next. Parents are keeping score of their child’s affection as though they were at a sporting event. Both parents fear losing ground as though their competition, the other parent, chips away at there own individual “power base”. This is an automatic reaction during a divorce. If only parents would stop for a moment and realize, that children have unconditional love for each of them.

Children were not beamed down from space to earth. They were conceived and brought into this world with the greatest expectations, and most of all love. By two people the child calls mother and father. These two people have forgotten that being a parent, role model and teacher, means not putting down the other. Or using the children to emotionally beat up the “competition”. Because, being a parent is a privilege!

A divorce is like a funeral. Of course, there is no casket or service. But the process is the same.
“Funeral” services begin when the parties enter their lawyers office, (I call them legal funeral representatives) they help prepare for the death of their clients marriage.

The lawyers seek out personal, confidential information about you, only to file it in a public record for the world to see.

Attached to this public record filing is a detailed financial description, (yours) of personal property and assets acquired during the marriage.

Somewhere between page 11 or 15 of the divorce agreement, your children are listed, like an asset, by name and age. And on yet another page, you will find the “children”, stating who gets custody when, on what days, with specific times and for how long. Can’t forget the holiday schedules, this appears on yet another page of the divorce decree. This page looks more like a major event schedule, trading odd and even years off during the holidays.

If parents would think for a moment and get off their “power base”, they should be able to work out these very private details among themselves.

Months, and in some cases years later a judge, who I refer to as the coroner (no disrespect intended) sit before these strangers, in a court of law, with people who once vowed to love, honor and cherish each other all the days of their lives, ask if all parties are in agreement, with the tap of his gavel, signs the death certificate (known more commonly as the divorce decree.

I for one think this process is a crime. We allow total strangers to settle our once very happy lives. The greater crime, however, is the children, divided up among the parents like a piece of property. They are the “Voiceless Victims.”

Getting the Right Lawyer for Your Case

Whenever you’re in need of a legal specialist for your lawsuit or even just for advice, acquiring one is never hard especially now that we already have the very useful Internet. With it, you must not worry that you’ll be getting a lousy lawyer because of its lawyer locators. These locators search vast databases of lawyer information that will match your lawyer requirements and qualifications. There are also online referral services that can help you find the best attorney for your case.

This feature of the Internet can certainly help you save time and effort. You must not be discouraged by the myriad law firms and independent attorneys who are present everywhere because the web is a more efficient means to locate them. The web offers fast and accurate way of tracking the best attorney for your case. Another thing is the fact that it only searches through records of competent, carefully-screened lawyers with a winning professional background in his area of law and your geographic region, too.

Professional background or the experience of an attorney in handling cases that are similar to your case is very important. Through this, you can make sure that you’ll put up a good fight and that you can expect for justice to be served on you. The geographic region is also a major consideration when choosing a legal specialist for your lawsuit. As we all know, laws vary from state to state. And your lawyer must be proficient enough in the area where the incident, that has lead to your case, has taken place.

When you use the Internet to locate a lawyer, you have to know that your location is also being considered and weighs tremendously in the search results. But this is only second to the lawyer’s capacity to handle your case successfully based on his previous experiences on the same type of case. Among others, the lawyer’s background is the most important thing to consider in hiring one to ensure that you’ll get the best legal assistance possible.

Finally, a good lawyer is someone who can identify the causes and the level of fault of your case. He is also the one that prepares and organizes the necessary documents that will be used in court trials to establish the truth. An advantage on your part is the fact that you don’t have to pay your personal injury attorney unless you win your settlement. But in other areas of the law, a consultation fee is being asked by some lawyers. With this, you have to be very keen in choosing the perfect lawyer to fulfill your legal needs.

5 Tips to Help Avoid a DUI Conviction

If you are ever arrested for drunk driving (also called DUI for "driving under the influence" or DWI for "driving while intoxicated"), your experience will begin with an officer stopping you because of some questionable driving pattern, or possibly because you encountered a DUI "sobriety checkpoint" or you were involved in an accident. The officer will approach your car and ask some questions. You will then be asked to perform "field sobriety tests". He may also ask you to breath into a handheld device, technically called a PBT or "preliminary breath test". You will then be arrested. On the way to the police station, you will be asked to submit to a breath or blood test -- and told that if you don't, your driver's license will be suspended.

What should you do and say during all of this to minimize the risk of a criminal conviction and a license suspension?

1. Politely decline to answer any questions without an attorney present. It is a cardinal rule in legal circles that only incriminating statements are included in police reports and later testified to in court; statements pointing to innocence are invariably ignored, forgotten or misinterpreted. Bluntly put, whatever you say will almost never help you and can only hurt you.

2. Decline to take any so-called field sobriety tests. These are theoretically intended to determine impairment, but in fact are designed for failure. In most cases, the officer has already made the decision to arrest and is simply going through the motions and gathering further evidence to bolster his case (he is the one who decides whether you "pass" or "fail"). In almost all states, you are not required to submit to this "testing". It's unlikely that taking it will change the officer's decision to arrest.

3. Decline to take a "PBT" (preliminary breath test). These handheld units are carried by officers in the field to help decide whether to arrest or not and are notoriously inaccurate. In most states, drivers are not required to submit to these tests (in some they are required if you are under 21). Although most states admit the results of these tests into evidence only to show the presence of alcohol, some permit them to prove the actual blood-alcohol level.

4. Do you choose blood, breath -- or refuse to take any chemical test? This is a case-by-case decision, and involves a number of considerations. First, although blood tests are subject to many possible errors, they are generally more accurate than so-called "breathalyzers"; if you feel your blood-alcohol level is below .08%, then you might want to choose the blood test. Secondly, whether to submit to testing at all requires some knowledge of your state's laws -- specifically, the consequences of refusing. If the increased criminal penalty and license suspension do not outweigh the possible benefit of depriving the prosecution of blood-alcohol evidence, then you may wish to refuse. Bear in mind that the prosecution will charge you with two offenses, DUI and driving with over .08% blood-alcohol; without a blood or breath test, he cannot prove the .08% charge, and there will be no chemical evidence to corroborate the officer's testimony. You should also realize that in many states chemical evidence of a very high blood-alcohol level, say over .15%, can trigger more severe penalties.

5. In almost all states, your driver's license will be immediately suspended if either (1) the chemical tests results are .08% or higher, or (2) you refuse to submit to testing. You have a right to a hearing to contest this administrative suspension, and there are many possible defenses, many of them technical in nature. This hearing is usually separate from the criminal proceedings, and involve different procedures and issues than in court; it is not uncommon to lose the criminal case but win the suspension hearing. However, as most motor vehicle departments do not really want the time and expense of providing these hearings, they tend to provide notice of the right buried in fine print given to arrestees. The critical information is the requirement that an actual demand for the hearing must be made by the arrestee -- usually within ten calendar days. If you do not contact the DMV within ten days, you lose all rights to a hearing -- no matter how good a defense you may have. Tip 5: Get an attorney right away, or make the call yourself -- and make sure you can later prove you made the call within the ten day window!
